Tribes file motion in Ancient One case

On Sept. 26, the Confederated Tribes of the Umatilla Indian Reservation, along with the Yakama Nation, Nez Perce Tribe and Colville Confederated Tribes, filed a motion for post judgment intervention in the litigation involving the Ancient One.


This means that the four claimant tribes would be parties to the litigation and able to appeal the recent decision on their own, rather than having to rely on the federal government to file such an appeal. The tribes were granted amicus curae, or friend of the court, status in the case but that status does not allow direct appeal.


"We took this action because we feel the court incorrectly interpreted the Native American Graves Protection and Repatriation Act (NAGPRA) to the point that the law no longer protects the fundamental human right of tribes to protect our ancestors," said Armand Minthorn, Chair of the CTUIR Cultural Resources Committee.


"We look forward to participating as full parties to this litigation in the appeals process. We hope to get a decision that conforms to NAGPRA, United States policy and Congressional intent," he said.
